Please read these terms and conditions carefully before using this site.

What is in these terms?

These terms tell you the rules for using our website (www.mypals.org.uk).

There are some words used within the terms (highlighted in black like this) that have a specific meaning. These words are:

  • Member – someone who registers on the site as a member
  • Volunteer – someone who registers on the site as a volunteer
  • Members and Volunteers are collectively referred to as “You”, “Your”
  • St Cuthbert’s Hospice – St Cuthbert’s Hospice which operates the site. A company incorporated in the United Kingdom (reg no 2208426) and registered as a Charity with the Charity Commission for England and Wales (reg no 519767) – referred to variously as “We” or “Us” or “Our”.
  • Site – our website, www.mypals.org.uk, occasionally referred to as the MyPals platform

Other terms

There are other terms that also apply to the use of our site:

Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using the site, you consent to such processing and you warrant that all data provided by you is accurate.

Our Acceptable Use Policy, which sets out the permitted uses of the site and also what is prohibited. When using the site, you must comply with this Policy.

Our Cookie Policy, which sets out information about the Cookies on our site.

Who we are and how to contact us

The Site is operated by St Cuthbert’s Hospice. Our registered address is St Cuthbert’s Hospice, Park House Road, Durham, DH1 3QG. You can contact us by writing to this address, by emailing [email protected], or by phoning 0191 386 1170. When contacting us, please make clear that you are contacting us in relation to MyPals.

By using our site you accept these terms

By using our site, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use our site.

We recommend that you print off a copy of these terms for future reference.

If you are under 18 years of age you must only use the site and provide personal information if you have the consent and supervision of a parent or guardian.

You are also responsible for ensuring that anyone who uses the site through your internet connection is aware of these terms of use and other applicable terms and conditions, and that they comply with them.

Safeguarding

We recognise that welfare and interests of children, young people and vulnerable adults are paramount in all circumstances.

We need your consent for any act of sharing information but we are required to share information that surrounds a minor or vulnerable adult if there is reasonable cause to suspect that a child or vulnerable adult is suffering, or is likely to suffer, significant harm (for example, physical, sexual, financial or emotional abuse, neglect, self-neglect, modern slavery and domestic abuse).

Our Safeguarding Policy and Safeguarding Procedure set how we prioritise your safety and how we report any concerns. We understand the importance of sharing information that could be considered sensitive. In cases of emergency, we may pass your IP address to the police in order to get help to you as quickly as possible.

If you have any concerns, either about how we implement our policy or if you have concerns about the well-being of a Member or Volunteer, please contact us using the information given above. In case of emergency, you can also contact your local Safeguarding Board (there are usually separate contact details for adults and children) or the police service.

Changes to these terms

We will amend these terms from time to time. Every time you use the site, please check these terms to make sure you understand the terms that apply at the time.

Changes to the site

We may update and change the site from time to time as we develop new services and respond to feedback from Members and Volunteers.

Suspending or Withdrawing the Site

The site is available free of charge.

We do not guarantee that the site will always be available. We may suspend, or withdraw, or restrict the availability of, all or any part of the site for business or operational reasons. We will try to give you notice of any suspension or withdrawal if possible.

You must keep your account details safe

If you choose, or are provided with, a user ID or password or any other information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

Suspending or withdrawing access to the site

We have the right to disable any user ID or password at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these terms of use.

How you may use material on our site

We are the owner of all intellectual property rights in the site and all such rights are reserved. You may print off one copy, and may download extracts, of any page(s) from the site for your personal use. You may also such downloads or prints to draw the attention of other potential Members or Volunteers to the site or to content posted on it. You must not modify the paper or digital copies of any material you have downloaded or printed off in any way.

Our status (and that of any identified contributors) as the authors of the content on the site must always be acknowledged.

You must not use any part of the content on the site for commercial purpose without obtaining a licence to do so from us.

If you print off, copy or download any part of the site in breach of these terms of use, your right to use the site will cease immediately and you must, at our option, return or destroy any copies of materials you have made.

Information on the site

Although we make reasonable efforts to update the information on the site, we make no representations, warranties or guarantees, whether express or implied, that the content on the site is accurate, complete or up to date.

Linked websites

Where the site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.

User-generated content

The site includes information and materials uploaded by other members of the site. This information and these materials have not been verified or approved by us. The views expressed by other users of the site do not necessarily represent our views or values.

Our responsibility for loss or damage suffered by you

The services (jobs) booked by a Member via the site are the sole responsibility of the Volunteer who provides the service. We act only as a facilitation platform for the booking of such services and are in no way responsible or liable to the Member for the actual services (jobs) that are performed.

The Member and the Volunteer are each entirely responsible for taking the necessary precautions to protect both their personal safety and property.

We make no warranty as to the quality, suitability or otherwise of the Volunteer to provide the services (jobs) and are not liable to the Member for any loss or damage you may incur as a result of being connected to a Volunteer.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so.

We do not give any commitments or accept any liability to you in respect of content posted by other users of the site or third parties. We are in no way bound by any promises or claims made either in writing or verbally by a Member or Volunteer to the extent they purport to bind us to any additional terms not contained in these Terms and Conditions.

We do not accept any liability for any loss which:

  • Arose when you first accessed the site
  • You suffer other than as a result of our failure to comply with these Terms or our negligence or our breach of a statutory duty
  • You suffer due to the default of any party other than us.

Uploading content to the site

When you make use of a feature that allows you to upload information or content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy. You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means that you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all your ownership rights in your content, but you grant us and other users of our site a limited licence to use, store, and copy that content and to distribute it and make it available to third parties. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy. We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.

Use of your personal information submitted to us is governed by our Privacy Policy and our Cookie Policy. Additionally, by using the site, you acknowledge that internet transmissions are never completely private or secure and that it is always possible that any message or information you send via the site may be read or intercepted by others.

We will comply with all applicable data protection legislation and ensure that at all times when we are processing personal data we take all appropriate measures to safeguard against unauthorised or unlawful processing of personal data and against any unauthorised or unlawful accidental loss, destruction of or damage to personal data and ensure the security of such personal data.

You are solely responsible for securing and backing up your content.

We are not responsible for viruses and you must not introduce them.

We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs, or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which it is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with these authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Rules about linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our site in any website that is not owned by you. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

We reserve the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy.

Which country’s laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland and if you are a resident of Scotland, you may also bring proceedings in Scotland.

If you are a business user, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
